1. Agreement

These Terms of Service ("Terms") govern your use of the FoudaTech Solutions website and services ("Services"). By engaging FoudaTech or using our Services, you agree to these Terms. Specific projects may also be covered by a separate written proposal or agreement, which takes precedence where it conflicts with these Terms.

2. Our services

FoudaTech provides custom web, mobile, and AI development, technical consulting, and the Interactive Tower Maps service. Tower Maps is offered as a managed service: a one-time setup fee to custom-build your tower map, plus a recurring subscription covering hosting, the management dashboard, support, and edits.

3. Tower Maps — fees & subscription

Setup fee — a one-time charge to design, map, and deliver your interactive tower map.
Subscription — a recurring fee (billed annually unless otherwise agreed) that keeps your map hosted, supported, and editable. The map remains active for the duration of a paid subscription.
Quoted prices are estimates based on the information you provide (number of towers, floors, and units) and may be adjusted by written agreement if scope changes.

4. Your responsibilities

You agree to provide accurate unit data, pricing, availability, and images, and you confirm that you hold the rights to any materials (including tower renders and photos) you supply. You are responsible for keeping pricing and availability up to date through the dashboard provided.

5. Payment

Setup fees are payable as set out in your proposal; work begins once the setup fee (or agreed deposit) is received. Subscription fees are billed in advance for each term. Late or unpaid subscription fees may result in suspension of the hosted map after reasonable notice.

6. Intellectual property

Your content — you own the data, images, and brand materials you provide, and the right to display your specific tower map.
Our platform — FoudaTech retains all rights to the underlying Tower Maps technology, widget, dashboard, source code, and tooling used to deliver the Services.

7. Acceptable use

You agree not to misuse the Services, including by uploading unlawful content, infringing third-party rights, or attempting to disrupt or reverse-engineer the platform.

8. Service availability

We aim to keep hosted maps available and performant but do not guarantee uninterrupted service. We may perform maintenance and will make reasonable efforts to minimise disruption. See our Security & Data page for more.

9. Warranties & liability

The Services are provided "as is" without implied warranties to the fullest extent permitted by law. To the maximum extent permitted by law, FoudaTech's total liability arising from the Services is limited to the fees you paid for the Services in the 12 months preceding the claim. We are not liable for indirect or consequential losses, including lost sales or profits.

10. Term & termination

You may cancel your subscription at the end of any paid term. On termination or non-renewal, the hosted tower map and dashboard access are deactivated; we can provide your project data on request. Either party may terminate for material breach that is not remedied within a reasonable period.

11. Confidentiality

Each party agrees to keep the other's non-public information confidential and to use it only to deliver or receive the Services.

12. Governing law

These Terms are governed by the laws of the Republic of Ghana. Disputes will be subject to the courts of Ghana, unless otherwise agreed in writing.

13. Changes

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
